The gaming company Epic Games has submitted a preliminary injunction asking the presiding US court to make its hugely popular game Fortnite available again on Apple’s App Store, and for the company to regain access to its developer account.
Last week, Apple closed Epic Games’ developer account and removed Fortnite from the App Store. This followed Epic (seemingly deliberately) violating the regulations by offering customers the option to pay it directly, bypassing the store’s usual fee structure.
Epic says it did this as a way to protest against Apple’s charges. It has also sued Apple, accusing the company of having a monopoly.
The company writes in its injunction that it chose to challenge Apple because “it was the right thing to do”, MacRumors reports, and adds that it was “better positioned than many other companies to weather the storm”.
Epic also writes that it will probably suffer “irreparable harm” if Fortnite is not allowed to return to the App Store. It says the number of active iOS players has already decreased by 60%.
Apple has previously said Fortnite is welcome back as long as Epic removes the direct payment feature – an ultimatum with which Epic has declined to comply.
